Somyi, a former member of the DIA, was given an 18-month prison sentence for fabricating allegations of sexual assault.




During the first trial, Somyi, a former member of the DIA, was sentenced to one year and six months in prison.


The former girl group member turned streamer, who falsely accused the CEO of her agency of sexual assault, was arrested after the verdict in the first trial and was given a prison sentence, according to News 1 on March 21.


Somyi, a former member of the DIA, was sentenced to one year and six months in prison by the Criminal 2nd Division of the Seoul Central District Court on this day.


In January 2023, Somyi had reported to the police that the CEO of her label had made an attempt to sexually assault her. After Somyi filed an appeal against the case's original dismissal, the police looked into the CCTV footage that showed the alleged sexual assault.


The video demonstrated Somyi's dishonesty. It depicted Somyi and the CEO leaving the room amicably at the moment of the purported assault. In addition, video showed Somyi hugging the CEO as she entered his office, refuting her allegations of being sexually assaulted.


The prosecution maintained that Somyi made up the accusations in order to get 'A' to break up with his girlfriend. Somyi, however, denied making up the accusations, and her attorney said that alcohol was impairing her judgment and prevented her from making wise choices.


The judge noted that this day, "While the victim's statements generally remain consistent both with the investigative agencies and in court, the defendant's statements lack consistency and do not align with the CCTV footage, resulting in low credibility."


The court stated, "Key evidence, including text messages and security footage, played a significant role in the accused's exoneration and the charges being dropped. The outcome might have seriously included criminal penalty in the absence of this evidence. The defendant attempted to explain her acts by arguing that she was under the effects of drink or mental medication and could not remember the events, despite the overwhelming evidence."



"False accusations are serious crimes that can subject the innocent party to unjust criminal punishment," the court went on to say. The offense is made more serious by the defendant's act of making false accusations and declarations to investigating agencies."
